We wish all our readers a happy and prosperous 2013! It is clear that tax does not take a break over the festive season judging from the tax legislation, binding rulings and regulations promulgated or issued during the latter part of 2012.

Most significant during this period was the promulgation of the Tax Administration Laws Amendment Act (Act No 21 of 2012) on 20 December 2012. Note however that the Taxation Laws Amendment Bill of 2012 is yet to be enacted.

In this June edition of Tax Flash we take a look at the Supreme Court of Appeal's recent judgment relating to the ‘exit tax' levied on the deemed disposal of assets triggered by a person ceasing to be resident in South Africa. The judgment prompted an immediate response from the Ministry of Finance suggesting that legislative changes may be required to restore the exit tax to its intended status however the effect of the judgment on the exit tax is questionable.
