A Trust is also very often misunderstood and mismanaged by the founder, trustees and beneficiaries, who get it wrong with disastrous consequences. Family dynamics, the lack of family conversation about the trust, and poor governance of the Trust are all factors that have unintended consequences in how the Trust eventually plays out over time.

Managing family wealth in a Trust can get complicated if there is no clear structure governing the family vision, family members’ roles and responsibilities and the purpose of the Trust. Normal family dynamics of marriage and divorce challenge any well thought through Trust Deed.

This is a 2-part discussion that unpacks the importance of conversations around family wealth and how a family constitution and Trust Deed should be aligned.

In part 1, Trevor will position the role of Family Governance to facilitate communication and decision-making guidelines relating to family businesses, the role of Directors and Trustees, Trusts and the protection of a multi-generational family legacy.

Session 3: Marrying family governance with the Trust Deed (Part 2)

Managing family wealth in a Trust can get complicated if there is no clear structure governing the family vision, family members’ roles and responsibilities and the purpose of the Trust.

In part 2 of this discussion, Phia discusses the importance of an appropriately structured Trust Deed and the need to revise a Trust Deed to deal with changes in the family structure, circumstances and legislation. She will discuss life transitions, such as divorce, re-marriage, succession and insolvency, and explore solutions to address unwanted ramifications these life events can have on Trust assets. She will also touch on historical legislation changes that necessitated trust deed amendments.
